These Terms govern your use of Zen Habits. By downloading, accessing, or using the app, you agree to these Terms and our Privacy Policy.

1. The Service

Zen Habits provides tools to create goals and habits, track progress, sync app data, import plans, and generate planning suggestions using artificial intelligence. You must be legally able to agree to these Terms. If you use the Service for an organization, you represent that you have authority to bind it.

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for lawful purposes in accordance with these Terms. You may not:

You retain ownership of content you submit. You grant us a limited license to host, process, transmit, and display it only as needed to operate, secure, and improve the Service and provide features you request. You are responsible for your content, your use of generated results, and maintaining access to your device credentials.

4. AI-generated suggestions

AI output may be incomplete, inaccurate, inappropriate, or unsuitable for you. It is provided as a planning aid and is not professional advice. Review all suggestions before relying on them. Do not use the Service as a substitute for medical, mental-health, legal, financial, nutrition, fitness, or other qualified professional advice. Stop an activity and seek appropriate help if it may be unsafe for you.

5. Purchases and subscriptions

Paid features may be offered as in-app purchases or auto-renewing subscriptions through Apple’s App Store or Google Play. Prices, billing, renewal, cancellation, refund eligibility, and payment processing are governed by the applicable store and the terms shown at purchase. Subscriptions renew unless canceled through your store-account settings before renewal. Deleting the app or app data does not automatically cancel a subscription.

6. Availability and changes

We may modify, suspend, limit, or discontinue any part of the Service, including features and usage allowances. We aim to keep the Service available but do not guarantee uninterrupted, secure, or error-free operation. You are responsible for keeping any copy of your data you need.

7. Intellectual property

The Service, including its software, design, branding, and original content, is owned by or licensed to Zen Habits and protected by applicable intellectual-property laws. These Terms do not transfer ownership to you.

8. Termination

You may stop using the Service at any time and may delete your app data through available app controls. We may suspend or terminate access if you materially violate these Terms, create risk or legal exposure, or misuse the Service. Provisions that by their nature should survive termination will survive.

9. Disclaimers

To the fullest extent permitted by law, the Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.

10. Limitation of liability

To the fullest extent permitted by law, Zen Habits and its suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or business interruption arising from the Service. Our total liability for claims relating to the Service will not exceed the greater of the amount you paid for the Service during the 12 months before the event giving rise to the claim or US $50. These limitations do not apply where prohibited by law.

11. Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Zen Habits and its suppliers from claims, losses, and expenses arising from your unlawful use of the Service, your content, or your violation of these Terms or another person’s rights.

12. Apple-specific terms

If you use the iOS app, these Terms are between you and Zen Habits, not Apple. Apple has no obligation to provide maintenance or support for the Service and is not responsible for claims relating to it, except as required by law. If the iOS app fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any, as permitted by its rules. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

13. Governing law and disputes

These Terms are governed by the laws applicable where the Service provider is established, without regard to conflict-of-law rules, except that mandatory consumer protections in your country or region continue to apply. Before filing a formal claim, please contact us and give us 30 days to try to resolve the dispute informally. You may also have rights to bring a claim before your local courts that cannot be waived.

14. General terms

If a provision is unenforceable, it will be modified to the minimum extent necessary and the remaining provisions will continue in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganization, merger, or transfer of the Service. These Terms and the Privacy Policy are the entire agreement concerning the Service.

15. Changes to these Terms

We may update these Terms. We will post the revised Terms here and update the date above. Your continued use after an update takes effect means you accept the revised Terms, where permitted by law.
